Terms of Service

1. Agreement to These Terms

These Terms of Service (the “Terms”) are a binding agreement between you and DemoGenius AI (“DemoGenius”, “we”, “us”) governing your use of our websites, dashboard, public demo player, embeds, Chrome extension, and APIs (the “Service”). By creating an account or using the Service, you agree to these Terms. If you use the Service on behalf of a company, you represent that you have authority to bind that company, and “you” refers to it.

2. The Service

DemoGenius lets you capture product walkthroughs, annotate them with captions, hotspots, CTAs, and lead forms, publish them as interactive demos, and enhance them with AI Skills such as caption generation, hotspot suggestions, redaction, narration, translation, viewer Q&A, and content repurposing. We may improve, add, or remove features over time; we will not materially reduce the core functionality of a paid plan during a paid term without notice.

3. Accounts and Organizations

You must provide accurate registration information and keep your credentials secure. You are responsible for all activity under your account. Workspaces are organized into organizations with roles (Owner, Admin, Member, Viewer); Owners and Admins are responsible for managing who has access to their organization’s demos, leads, and settings. Notify us immediately at security@demogenius.ai if you suspect unauthorized access.

4. Plans, AI Credits, and Usage Limits

Each plan includes limits—for example the number of demos, published demos, team seats, storage, monthly views, and monthly AI credits. AI Skills consume AI credits at the rates shown in the product. Unless your plan states otherwise, unused monthly credits do not roll over, credits have no cash value, and credits are not refundable. We may enforce limits technically, and we may throttle or queue usage that exceeds fair-use thresholds to protect the Service for all customers. Current plan details are listed on our pricing page.

5. Payments and Refunds

Paid subscriptions are billed in advance on a monthly or annual basis through Stripe, our payment processor. Prices exclude taxes, which you are responsible for where applicable. Subscriptions renew automatically until canceled; you can cancel at any time from your billing settings, effective at the end of the current billing period. Except where required by law, fees are non-refundable and we do not provide credits for partial periods, downgrades, or unused features. If a payment fails, we may retry it and, after notice, suspend paid features until payment is made. We may change prices with at least 30 days’ notice, effective on your next renewal.

6. Your Content

You own the content you submit to the Service, including screenshots, captured walkthroughs, captions, narration, translations, brand assets, and the demos you assemble from them (“Customer Content”). You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, transmit, and display Customer Content solely as needed to operate, secure, and improve the Service—including processing it through the AI and storage subprocessors described in our Privacy Policy when you invoke those features, and displaying published demos to the audiences you share them with. This license ends when the content is deleted, except for transient backup copies. You are responsible for having the rights to everything you capture and publish, including third-party interfaces, trademarks, and any personal data visible in your screenshots.

7. AI-Generated Content

AI Skills produce machine-generated output based on your content and instructions. Output may be inaccurate, incomplete, or unsuitable for your purpose, and similar output may be generated for other customers. You must review AI output before publishing or relying on it; it is not professional, legal, or financial advice. As between you and us, and to the extent permitted by law, we assign to you our rights in AI output generated for you within the Service. You remain responsible for how you use and publish AI output, including translated and narrated versions of your demos.

8. Acceptable Use

You agree not to misuse the Service. In particular, you will not:

  • upload or publish content that is unlawful, infringing, deceptive, or malicious, or that violates the privacy or rights of others;
  • capture or publish credentials, personal data, or confidential information you are not authorized to disclose;
  • use demos, lead forms, or the viewer assistant for phishing, spam, or impersonation;
  • probe, scan, overload, or attempt to bypass security, rate limits, plan limits, or the AI credit system;
  • reverse engineer the Service except where permitted by law, or resell it without a written agreement with us;
  • use the Service to build a directly competing product, or scrape content from demos you do not own.

We may remove content or suspend accounts that violate this section, with notice where practicable.

9. Our Intellectual Property

The Service—including our software, AI Skill orchestration, player, extension, designs, and branding—is owned by DemoGenius and its licensors and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service during your subscription in accordance with these Terms. Feedback you choose to send us may be used without restriction or obligation.

10. Third-Party Services

The Service integrates with third parties such as Stripe for payments, Google for sign-in, storage providers for media, and Anthropic for AI processing. Your use of a third-party service is governed by that provider’s terms, and we are not responsible for third-party services we do not control. Integrations you connect (for example webhooks or CRM tools) act on your instructions.

11. Termination

You may stop using the Service and delete your organization at any time. We may suspend or terminate your access if you materially breach these Terms, if your use creates security or legal risk, or if required by law—where reasonable, after notice and a chance to cure. Upon termination, your right to use the Service ends and published demos are unpublished. For 30 days after termination (except termination for serious breach), we will make your Customer Content available for export on request, after which we may delete it in accordance with our Privacy Policy. Sections that by their nature should survive—including ownership, disclaimers, liability limits, and governing law—survive termination.

12. Disclaimers

The Service is provided “as is” and “as available”. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty that the Service will be uninterrupted, error-free, or that AI output will be accurate or reliable. You are responsible for maintaining copies of source materials you upload.

13. Limitation of Liability

To the maximum extent permitted by law, neither party will be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, even if advised of the possibility. Except for your payment obligations, your breach of Section 8, or either party’s infringement of the other’s intellectual property, each party’s total liability arising out of the Service is limited to the amounts you paid us in the 12 months before the event giving rise to the claim (or USD 100 if you have paid nothing). Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

14. Governing Law, Changes, and Contact

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws rules, and disputes will be resolved in the state or federal courts located in Delaware, whose jurisdiction both parties accept. We may update these Terms from time to time; for material changes we will give at least 14 days’ notice by email or in-product message, and continued use after the effective date constitutes acceptance.
